QXL chief banned from calling the shots in Poland

The ruling, which has been viewed in part by netimperative and is adorned with an official stamp from the Polish court where the case is being heard, says that CEO Mark Zaleski and CFO Robert Dighero are not allowed to take any decisions related to internal or external matters at QXL Poland.
This overrules the injunction awarded to QXL in early April and has dented its chances of reclaiming the disputed 92% shareholding that Poland-based NIAA holds in the subsidiary. The company has been battling to regain control of the Polish arm, which trades under the name Allegro, for the past few months.
Arjan Bakker, who heads up QXL in Poland and is at the centre of the fight for its ownership, claims that Zaleski is to be "officially dismissed" from the Polish subsidiary at a shareholders meeting on 15 May.
In a seperate criminal trial, Zaleski is accused of using a forged company document in order to be added to the company register of QXL Poland at the country's equivalent of Companies House.
The alleged forgery stated Zaleski was part of the management team and the court concluded that his intent was "to transfer a very significant part of the assets of QXL Poland into QXL Ricardo".
QXL said earlier this month that it had launched a criminal case of its own against Bakker, who it believes had a hand in its loss of control over the Polish division. Bakker added that the case had been widened to include other individuals.
QXL company secretary Tom Parkinson yesterday said he doubted the validity of the documents, but said the company would investigate the claims.
The company is due to release its interim results by the end of May.
